Hannes joined the firm in 2000 as a director and now heads up the Insurance Law Department, assisted by Maudie Fritz. The department also specialises in motor vehicle accident recoveries and defence of third party claims, Civil-Magistrates' Court, Regional Court and High Court litigation.
Hannes matriculated in 1989 at Menlo Park High School in Pretoria. He commenced his studies at the University of Pretoria the following year and completed his B.Com Law degree in 1992 and his LL.B degree in 1994, after which he joined Savage Jooste & Adams Attorneys where he completed his articles.
In 1996 Hannes was admitted as an attorney and conveyancer of the High Court of South Africa. Due to his interest in the law of insurance he joined Samib Underwriting Managers as their legal manager. He gained extensive experience in the field of insurance law but missed the joy of practising and returned to practise at Van der Merwe du Toit Inc. in Pretoria as professional assistant.
Hannes represented Lloyd’s of London in the well-known and reported matter of Napier v Barkhuizen 2007 (5) SA 323 CC where there was a constitutional challenge on a contractual time limitation clause in a contract of insurance. This is the first matter where the Constitutional Court considered whether the Bill of Rights should apply horizontally and it confirmed that individual clauses in agreements may be tested against the Constitution.
Married with two daughters, Hannes and his family enjoy the outdoors and horse riding. Their passion is endurance horse riding, a sport that the whole family can enjoy. They find the sport demanding yet extremely fulfilling. In the words of the former American President Ronald Reagan – “There is nothing better for the inside of a man than the outside of a horse.”
